Tikecik Terms of Service for Buyers
§ 1. General provisions
- These Terms set out the rules for using the Tikecik online service, where you can browse events, and the buyer account.
- The Service is operated by e-back Sebastian Bauer, Miedniewice 167, 96-100 Miedniewice, NIP 836-177-50-92 (hereinafter: the Operator), entered in the Central Register and Information on Economic Activity (CEIDG).
- You can contact the Operator at the e-mail address info@tikecik.pl or by post to the registered office address.
- These Terms are made available free of charge in the Service in a way that allows them to be downloaded, saved and printed.
- These Terms do not apply to organizers using the Tikecik platform to sell tickets; their rights and obligations are set out in separate terms for organizers.
§ 2. Definitions
- Service – the Tikecik portal with information about events, available at tikecik.pl, together with the buyer account.
- Organizer – a business or other organization that organizes an event and sells tickets for it in its Shop.
- Shop – the Organizer’s ticket sales website operating on the Tikecik platform, at the address in the tikecik.pl domain or in the Organizer’s domain.
- Buyer (you) – a person using the Service, including a person who has created an Account.
- Account – a free electronic service provided by the Operator, available after logging in, in which the Buyer can see their data, tickets, orders and invoices.
- Consumer – a Buyer who is a natural person using the Service for purposes not directly related to their business or professional activity. The provisions concerning Consumers also apply to a natural person running a business when the contract is not of a professional nature for them.
§ 3. The role of Tikecik and ticket purchases
- The Service presents the Organizers’ events. Event information, including the date, venue, prices and terms of participation, is provided by the Organizer, who is responsible for its accuracy.
- The purchase button takes you to the Organizer’s Shop. You buy the ticket from the Organizer: the Organizer is the seller of the ticket and the party to the sales agreement, which is concluded under the terms and conditions of its Shop.
- The Operator is not a party to the ticket sales agreement or to the agreement for participation in the event. Payment goes to the payment operator with which the Organizer has concluded an agreement.
- Matters concerning the event, the ticket, payment, refunds, cancellation or changes to the event, ticket invoices, and complaints about these matters must be raised with the Organizer in accordance with the terms and conditions of its Shop.
- If you do not know how to contact the Organizer, write to the Operator - we will forward your message to the Organizer.
§ 4. Technical requirements
- To use the Service, you need a device with internet access, an up-to-date web browser with JavaScript and cookies enabled and – to create an Account – an active email address.
- Using the internet involves common risks, such as malware and phishing attempts. The Operator never asks for your password by email.
§ 5. Buyer account
- Creating and maintaining an Account is voluntary and free of charge. An Account is not required to buy a ticket in a Shop.
- You create an Account by providing your email address, first name, password and, optionally, your surname and phone number, and then clicking the activation link sent to that address. You can also create an Account and sign in to it with a Google account.
- The Account agreement is concluded for an indefinite period when the Account is activated.
- Provide true information and keep it up to date in your Account settings. The Account is intended for one person; do not share your password with others.
- In your Account you can: change your details and password; view tickets and orders placed while logged in to Organizers’ Shops, download tickets as PDF and display the ticket code; view invoices for those orders; unsubscribe from Organizers’ newsletters; link or unlink Google sign-in.
- Once logged in to your Account, you can also use it to log in to Organizers’ Shops. The Shop can then fill in the order form with your Account data (first name, surname, address, invoicing details), which you can change before placing the order.
- You can delete your Account at any time in your Account settings (“Delete account”). Deleting the Account deactivates it and removes your personal data from it. It does not delete order data that Organizers retain as sellers, including because of tax regulations.
§ 6. Rules for using the Service
- Use the Service in accordance with the law, these Terms and good practice.
- It is prohibited to provide unlawful content, to take actions that hinder or disrupt the operation of the Service, to attempt to access other people’s Accounts, and to download data from the Service in bulk by automated means.
- The Operator may suspend an Account that is used in breach of section 2, informing the Buyer by email and stating the reasons.
§ 7. Liability
- The Operator takes care to ensure the continuous and secure operation of the Service. Technical interruptions may occur, in particular during maintenance and updates; we try to announce longer planned interruptions in advance.
- The Operator is not liable for the course of events, the performance of ticket sales agreements or event information provided by Organizers; the Organizer is responsible for these matters.
- The provisions of these Terms do not exclude or limit the Operator’s liability towards Consumers to the extent that the law prohibits such exclusion or limitation.
§ 8. Complaints about the Service and the account
- You can submit a complaint about the operation of the Service or the Account by email to info@tikecik.pl or by post to the Operator’s registered office address.
- In the complaint, describe the problem and provide the Account email address (if applicable) and the date the problem occurred. This will help us resolve it faster.
- The Operator responds to a complaint within 14 days of receiving it, to the email address from which it was sent or in the manner indicated in the complaint.
- Complaints about tickets, payments and events are handled by the Organizer (§ 3 section 4).
- Consumers may use out-of-court complaint and redress mechanisms, in particular through the municipal or district consumer ombudsman or the provincial inspector of the Trade Inspection. Information about these methods is available on the website of the Office of Competition and Consumer Protection (uokik.gov.pl).
§ 9. Termination of the account agreement
- You may terminate the Account agreement at any time, without giving a reason and at no cost, by deleting the Account (§ 5 section 7) or by writing to the Operator.
- The Operator may terminate the Account agreement with 14 days’ notice for valid reasons, such as the discontinuation of the Service or a change in the law, informing the Buyer by email.
- In the event of a gross or persistent breach of these Terms, despite a request to stop the breach, the Operator may terminate the agreement with immediate effect, informing the Buyer by email and stating the reasons.
- The Account is a free service; termination of the agreement does not involve any fees.
§ 10. Personal data and cookies
- We describe how personal data is processed in the Privacy Policy, and how cookies are used in the Cookie Policy.
§ 11. Changes to these Terms
- The Operator may amend these Terms for valid reasons, in particular a change in the law or a change in the Service’s features or the way it operates.
- We notify Account holders of any change by email at least 14 days before it takes effect and publish the new version in the Service. If you do not accept the changes, you may delete your Account before that date.
§ 12. Final provisions
- These Terms are governed by Polish law. This choice of law does not deprive the Consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence.
- Disputes with Consumers shall be resolved by competent courts in accordance with general provisions. Disputes with Buyers who are not Consumers shall be resolved by the court having jurisdiction over the Operator's registered office.
- These Terms are available in Polish, English and German. In the event of any discrepancy, the Polish version prevails.
